Moving back to India after working or studying abroad? Eligible returning passengers can claim Transfer of Residence customs concessions on personal and household articles, with an allowance of up to ₹7.5 lakh under the Baggage Rules, 2026. The amount depends on your qualifying stay, the articles you bring and the conditions attached to your claim.
For Indians returning from the United States on H-1B or J-1 visas, the important distinction is simple: your U.S. visa category does not decide your Indian customs allowance. Customs looks at your eligibility, travel history, previous concessions and baggage. Your U.S. immigration and tax obligations need separate attention.
Last reviewed: November 2026. This guide covers personal relocation baggage, not commercial imports.

Who Qualifies for Transfer of Residence Customs Benefits?
Transfer of Residence, usually shortened to TR, provides customs concessions for qualifying personal and household baggage. Rule 7 of the Baggage Rules, 2026 contains the framework.
For returning residents and tourists of Indian origin, Appendix I sets out allowances based on time abroad. The highest allowance has additional conditions; it is not available simply because a passenger describes a shipment as “household goods.”
For the ₹7.5 lakh tier, check these three conditions:
- At least two years abroad immediately before arrival on transfer of residence.
- Short visits to India during the preceding two years total no more than six months.
- The passenger has not used this concession during the preceding three years.
The notification uses six months for the India-visit limit. Prepare an accurate travel history rather than treating an informal “180-day rule” as a substitute for the actual wording.
Can Customs relax the stay requirement?
Specified officers can consider a shortfall of up to two months in the overseas stay for terminal leave, vacation or other recorded special circumstances. Excess short visits to India can also be considered by the designated senior authority in special circumstances.
These are discretionary relaxations, not automatic extensions. The restriction on having used the concession in the preceding three years has no relaxation in the relevant table.

Transfer of Residence Duty-Free Allowances in 2026
The following table summarises Appendix I for returning residents and tourists of Indian origin. Each allowance applies to eligible articles, not unrestricted purchases of any kind.
| Qualifying stay abroad | Maximum eligible value | Additional conditions |
|---|---|---|
| Three months up to twelve months | ₹1,50,000 | Eligible personal and household articles; applicable item restrictions remain. |
| At least one year during the preceding two years | ₹3,00,000 | This concession must not have been used in the preceding three years. |
| At least two years immediately preceding arrival on TR | ₹7,50,000 | India visits within the prescribed six-month limit and no use of this concession in the preceding three years. |
Annexure II articles are limited to not more than one unit each within the applicable aggregate allowance. Do not assume unused value allows duplicate appliances.
The government’s 2026 baggage-rule announcement confirms the increased TR limits.
Is the normal ₹75,000 allowance additional?
Rule 7 provides TR benefits in addition to the applicable ordinary baggage relief. However, the general allowance under Rule 5 is for qualifying articles carried on the passenger or in accompanied baggage.
Do not automatically add ₹75,000 to the allowance for a separately shipped container. General allowances cannot be pooled between passengers either. Ask the clearing agent to identify the legal basis for each allowance claimed.
What about foreigners moving to India?
Appendix II contains separate conditions for qualifying foreigners with non-tourist visas. Some tiers depend on the subsequent stay in India, rather than simply the previous stay overseas.
Do not apply the returning-Indian table to every foreign passport holder. Where a concession depends on a prescribed stay in India and that stay falls short, Rule 7 requires notification to Customs and payment of applicable duty and interest.
Returning to India on an H-1B or J-1 Visa
Whether you are returning after a job change, layoff, research appointment, training programme or a family decision, prepare your customs claim around the facts of your move.
- H-1B workers: Keep employment records, approval notices and travel records that help establish your overseas residence.
- J-1 participants: Keep DS-2019 forms, programme dates and relevant employment or institutional records.
- Accompanying family: Document each person’s travel history and identify ownership of valuable items.
- Urgent return: If you fall short of a qualifying stay, ask about the applicable lower tier or a permitted relaxation before dispatching goods.
Example: A returning professional with several years abroad should first check the ₹7.5 lakh conditions. Someone returning after fourteen months should examine the ₹3 lakh tier. Neither person qualifies merely because their passport contains an H-1B or J-1 visa.
A short visit for visa stamping is also different from a genuine household relocation. Describe your circumstances accurately when seeking clearance.
Which Household Goods and Electronics Can Qualify?
Eligible personal and household articles can include furniture, kitchen belongings and other domestic possessions. The 2026 Annexure II also specifically lists numerous appliances and electronic items for TR treatment.
| Category | Examples in Annexure II |
|---|---|
| Kitchen and laundry | Refrigerator, microwave, washing machine, dishwasher, air fryer, electric oven and dryer |
| Computing and entertainment | Desktop computer, laptop or notepad, television, tablet, gaming console and projector |
| Home comfort and cleaning | Air conditioner, air cooler, air purifier, dehumidifier, vacuum cleaner and robotic vacuum cleaner |
| Other listed articles | Musical instrument, multifunction printer, massage chair and amplifier |
These are examples from the list, not separate allowances. Their eligible values count toward the relevant TR cap, and the one-unit restriction applies to each listed article.
Can I bring a television duty-free under TR?
A television can qualify under the TR provisions. Although televisions are excluded from the ordinary general baggage allowance, they are expressly included in Annexure II for TR. Eligibility, quantity and the aggregate value limit still matter.
Do not confuse the rules for a holiday passenger bringing a television with those for a qualifying relocation shipment.
Must everything have been owned for one year?
Rule 7 and Appendix I do not impose a blanket one-year ownership requirement on every household article. Keep receipts and ownership evidence, but do not rely on an outdated claim that every item must be at least a year old.
Equally, this is not permission to import commercial stock. Describe new and used items honestly. Removing packaging does not change an article’s legal treatment.
Can I bring two laptops or duplicate appliances?
Declare every unit and identify its purpose. A second computer might be your employer’s property, a family member’s device or a new purchase; those facts should appear in the inventory.
Do not assume the TR allowance covers duplicates simply because the total value is below the cap. Any separate relief must be assessed on its own conditions.
See our laptop customs guide and used electronics guide.
Gold, Jewellery and Restricted Articles
TR is not a blanket exemption for gold bars, silver bullion, weapons or other restricted goods. These need separate examination under the applicable rules.
For eligible residents or tourists of Indian origin returning after more than one year abroad, Rule 6 provides a separate jewellery allowance of 40 grams for female passengers and 20 grams for other passengers. Gold bars and coins are not covered by that jewellery concession.
Read the India gold customs guide before packing valuables. Keep jewellery and essential documents accessible rather than burying them in a household shipment.
Firearms require a separate legal assessment. Do not place one in relocation baggage based on a mover’s assurance that “TR covers everything.” See Transfer of Residence: Can NRIs Bring Guns to India?
Documents to Prepare Before Shipping
Ask the customs station or your authorised broker for the checklist applicable to your shipment. A useful preparation file includes:
- Current passport and relevant old passports.
- A dated record of overseas residence and visits to India.
- Visa, residence, employment or programme records supporting that history.
- An itemised packing list with numbered boxes.
- Brand, model, serial number, quantity, age and realistic value for major articles.
- Purchase invoices or other ownership evidence where available.
- Bill of lading or air waybill and shipment arrival details.
- Indian delivery address, contact details and requested identity/KYC documents.
- Details of previous TR concessions.
- Broker authorisation and any required permits or certificates.
PAN or Aadhaar may be requested for relevant identification or processing, but neither proves how long you lived abroad. Keep travel and residence evidence separately.
Make the inventory useful: “Box 12: used kitchen utensils” is better than “miscellaneous.” List valuable electronics individually and photograph their serial numbers before packing.
Unaccompanied Baggage: Shipping Deadlines and Clearance
Household goods sent separately from your flight may be processed as unaccompanied baggage when the relevant conditions are met. Ordinary online shopping or commercial cargo does not become relocation baggage merely because it is addressed to you.
When must the goods be dispatched?
Rule 10 provides for goods in the passenger’s possession abroad to be dispatched within one month of arrival in India, subject to the authorised officer’s powers concerning the period.
Dispatch is not the same as delivery. A shipment leaving the origin country and a container reaching an Indian port are different events.
Can goods arrive before I do?
The rule provides for unaccompanied baggage landing up to two months before the passenger arrives. A longer period, not exceeding one year, requires the specified officer’s approval and recorded reasons relating to circumstances preventing timely arrival.
Do not treat that provision as a routine one-year shipping window. Obtain advice before booking if the passenger and cargo schedules fall outside the normal sequence.
The rules do not establish the draft’s separate “one month for sea” and “15–60 days for air” formula. Use Rule 10 and the clearance station’s instructions.
Which declaration form applies?
CBD-II is the unaccompanied baggage import declaration form. The 2026 regulations provide for electronic declarations with supporting documents and permit an authorised person to file for unaccompanied baggage.
Find the forms through the Delhi Customs traveller resources. The legal procedure appears in the Customs Baggage (Declaration and Processing) Regulations, 2026.
Will Customs inspect every box?
The regulations provide for risk-based verification. Customs can examine baggage and request supporting evidence, but a blanket statement that every TR shipment undergoes 100% inspection is not an accurate description of the published framework.
- Confirm the proposed TR claim before dispatch.
- Prepare the inventory and shipment documents.
- Submit the required declaration and supporting records.
- Respond to any eligibility, valuation or examination queries.
- Pay assessed duty and other applicable charges, then arrange release and delivery.
Can You Bring a Car, Motorcycle or Pet When Moving Back?
Cars and motorcycles
Do not treat a vehicle as an ordinary household article within the ₹7.5 lakh allowance. Before shipping, obtain a separate assessment of import eligibility, vehicle specifications, testing, registration requirements and total landed cost.
For a U.S. vehicle, specifically ask about steering configuration and compliance. Ownership abroad does not, by itself, establish that the vehicle can be imported and registered in India.
Start with our car import guide or motorcycle import guide, then verify the requirements for the exact vehicle before paying freight.
Pets
Pet relocation involves separate animal-health and import requirements. Arrange the necessary approvals, veterinary documents and airline transport in advance; the household-goods allowance does not replace them.
H-1B and J-1 Returnees: Keep U.S. Tax and Immigration Separate
Indian Customs clearance does not settle your U.S. tax return, employment petition or future eligibility to return. Before leaving, arrange access to payroll, tax and immigration records even after your employer or university account closes.
Leaving does not automatically mean an “exit tax”
U.S. expatriation-tax provisions concern specified citizenship and long-term permanent-residency situations. An H-1B or J-1 holder does not automatically incur expatriation tax simply by moving to India.
However, departure-year income-tax filings and other obligations may remain. A dual-status return is not automatic: the result depends on the applicable residency tests, dates and circumstances.
Consult the IRS guidance on residency starting and ending dates and expatriation tax.
Check FBAR and departure-clearance obligations
FBAR concerns reportable foreign financial accounts of a U.S. person when their aggregate value exceeds $10,000 at any time during the calendar year. It is not a test that adds ordinary U.S.-located accounts to foreign accounts.
See FinCEN’s FBAR guidance. Also check whether you need an IRS departure clearance or “sailing permit”; exemptions depend on the circumstances.
J-1 return requirements are a different “two-year rule”
Some J-1 participants are subject to the U.S. two-year home-country physical-presence requirement. It is separate from India’s two-year overseas-stay test for the highest TR allowance.
Do not assume every J-1 holder is subject to it, or that receiving Indian customs relief satisfies it. Review the State Department’s exchange-visitor guidance with your programme adviser.
For H-1B workers considering a future return, obtain case-specific advice about the petition, employment and visa documentation. Avoid assuming that leaving India again will be straightforward merely because an old visa stamp remains in the passport.
Should You Ship Everything or Buy Again in India?
Duty-free does not mean cost-free. Compare the cost of packing, freight, insurance, destination handling, brokerage, storage and delivery with the cost of replacing the item in India.
- Check electrical labels: A plug adapter does not convert voltage. Confirm the input voltage and frequency accepted by each appliance.
- Check warranty coverage: Ask whether the manufacturer supports the model in India.
- Measure bulky items: Confirm that furniture and appliances fit your new home, lift and stairwell.
- Read transit insurance exclusions: Understand coverage for owner-packed goods, fragile electronics and internal damage.
- Ask about destination charges: A low freight quote can exclude significant clearance and delivery costs.
- Keep essentials with you: Documents, medication and necessary work equipment should not depend on the container arriving promptly.
Before accepting a “duty-free relocation package,” request an itemised explanation. Ask which allowance applies, which articles are excluded, what happens if Customs changes the valuation, and who pays storage charges during a delay.
Frequently Asked Questions
Do I have to live abroad for two years to get any TR benefit?
No. Appendix I also contains lower allowances. The two-year requirement relates to the highest ₹7.5 lakh tier, together with its other conditions.
Can I claim TR after returning because of a layoff?
Your reason for returning does not automatically disqualify you. Check the relevant stay requirements and other conditions. If your return is early, seek advice about a lower tier or a permitted relaxation before shipping.
Is the ₹7.5 lakh allowance a cash benefit?
No. It is a customs exemption limit for eligible articles, not money paid to a returning passenger. Unused allowance is not refunded.
Does a used item have no customs value?
No. Describe its age and condition honestly and provide available evidence. Do not assign a zero or token value simply because an article is used.
Is TR governed by Rule 6 or Rule 7?
Under the Baggage Rules, 2026, TR is under Rule 7. Rule 6 concerns the special jewellery allowance. Older references may use the numbering from previous rules.
What happens if my shipment exceeds the allowance?
Ask for an assessment identifying the eligible allowance, excluded or excess goods, valuation and applicable duty. Do not assume one percentage applies to every article in a mixed shipment.
Can my family combine allowances for one shipment?
Do not assume a family container automatically receives multiplied allowances. Document each claimant’s eligibility and ownership, and obtain confirmation of how the claim will be assessed. Rule 5 expressly prohibits pooling general free allowances.
Do old comments on this page still apply?
They may describe rules or procedures in force when the comment was posted. Compare the comment date with the current rules before relying on old allowance amounts, appliance restrictions or shipping advice.
